These Terms and Conditions (“Terms”) govern your access to and use of the PickABoo Dating App website, mobile applications, and related services (collectively, the “Services”) operated by PickABoo Dating App, LLC (“PickABoo Dating App,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

1. ACCOUNT ELIGIBILITY; YOUR RESPONSIBILITIES

Before you create an account on PickABoo Dating App, make sure you are eligible to use our Services. This section also details what you can and cannot do when using the Services, as well as the rights you grant PickABoo Dating App.

You are not authorized to create an account or use the Services unless all of the following are true, and by using our Services you represent and warrant that:

• You are an individual (not a business entity) at least 18 years old;
• You are legally qualified to enter into a binding contract with PickABoo Dating App;
• You are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country;
• You are not on any list of individuals prohibited from conducting business with the United States (including the U.S. Treasury Department’s Specially Designated Nationals list or similar lists)
• You are not prohibited by law from using our Services
• You have not committed, been convicted of, or pled no contest to a felony, violent crime, or sex crime, unless you have received clemency for a non-violent crime and we determine you do not pose a risk to users
• You are not required to register as a sex offender
• You do not have more than one account
• You have not previously been removed from our Services or affiliates’ services without express written permission

If you cease to meet these requirements, your authorization to use our Services is automatically revoked. You must immediately delete your account, and we may remove access without notice.

1.1 You Agree To:

• Comply with these Terms and review them periodically
• Follow all applicable laws and regulations
• Use the latest version of the Website and/or App
• Protect the security of your login credentials

1.2 You Agree Not To:

• Misrepresent identity, age, or affiliations
• Damage, disrupt, or impair the Services
• Interfere with servers or networks
• Use Services for illegal, harmful, or fraudulent purposes
• Harass, bully, stalk, intimidate, or abuse others
• Post Prohibited Content
• Solicit passwords or personal data unlawfully
• Solicit money or items of value from other users
• Use another user’s account
• Engage in fraud or pyramid schemes
• Use Services for political campaign financing
• Violate license terms
• Disclose private or proprietary information unlawfully
• Copy, distribute, or create derivative works without permission
• Claim endorsement by PickABoo Dating App
• Use bots, scrapers, or automated tools
• Upload malware or malicious code
• Manipulate identifiers or headers
• Frame or mirror the Services
• Use trademarks or branding without permission
• Reverse engineer or decompile the Services
• Develop third-party integrations without consent
• Access APIs without permission
• Test system vulnerabilities
• Encourage violations of these Terms
• Create new accounts after suspension without permission
• Submit false or abusive reports.

Violation results in automatic revocation of license and access.

2. PROHIBITED CONTENT

PickABoo Dating App prohibits uploading or sharing content that:

• Harasses, abuses, or causes psychological distress
• Is obscene, pornographic, violent, or contains nudity
• Promotes discrimination, hate, or bigotry
• Encourages illegal activity
• Promotes self-harm or dangerous behavior
• Is defamatory or false
• Promotes commercial services, sex work, or solicitation
• Is spam
• Contains malicious software
• Infringes third-party rights
• Was not created by you without authorization
• Uses someone’s likeness without consent
• Shows minors improperly or sexually
• Is inconsistent with the Services’ purpose
• Damages PickABoo Dating App’s reputation

Uploading Prohibited Content may result in immediate suspension or termination.

3. CONTENT MONITORING POLICY

PickABoo Dating App uses AI technology provided by Sightengine to review and monitor user-generated content.

We strictly prohibit explicit or adult content of any kind. Content identified as explicit, pornographic, or otherwise violating our policies may be automatically blocked, removed, or reported.

We reserve the right to review, remove, restrict, or disable any content or account at our discretion.

4. AGE VERIFICATION POLICY

PickABoo Dating App is strictly for users 18 years of age or older.

We verify age using the date of birth provided during registration. Providing false age information is a violation of these Terms.

PickABoo Dating App also uses AI technology provided by Sightengine to review and monitor underage content.

If we determine a user is under 18, the account will be immediately terminated.

5. REFUND POLICY

Generally, all purchases are non-refundable.

Special refund rights may apply in:

• EU, EEA, UK, Switzerland, Korea, Israel
• Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, Wisconsin

Except where required by law, purchases are final and there are no refunds for partially used periods.

6. VIRTUAL ITEMS

Virtual items are non-refundable and subject to conditions.

ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS ARE FINAL AND NON-REFUNDABLE.

PickABoo Dating App is not required to provide refunds. No compensation is provided for unused items when accounts close, voluntarily or involuntarily.

7. PURCHASES AND AUTOMATICALLY RENEWING SUBSCRIPTIONS

PickABoo Dating App may offer subscriptions and paid features.

Subscriptions automatically renew until canceled.

Purchases may be made through:

• Apple App Store
• Google Play
• Other authorized external services (“External Service Purchases”)
• Direct payment through website or app (“Internal Purchases”)

If canceled, subscription benefits remain until the billing period ends.

Canceling a subscription does not delete your profile. To terminate your account fully, contact PickABoo Dating App.

8. INAPPROPRIATE CONTENT AND MISCONDUCT; REPORTING

PickABoo Dating App does not tolerate inappropriate content or behavior on or off the Services.

Users are encouraged to report misconduct using the Report User feature on profiles or within messaging.

We may investigate and take action including warnings, suspension, or termination.

9. TERMINATION

We may suspend or terminate access at any time for violations or safety concerns.

Users may terminate accounts at any time.

10. DISCLAIMER OF WARRANTIES

Services are provided “as is” without warranties of any kind.

We do not guarantee matches, interactions, or outcomes.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, PickABoo Dating App is not liable for indirect, incidental, consequential, or punitive damages.

12. CHANGES TO TERMS

We may update these Terms at any time. Continued use constitutes acceptance.

13. GOVERNING LAW

These Terms are governed by the laws of the jurisdiction in which PickABoo Dating App, LLC is established, unless otherwise required by consumer protection laws.
